Scope and company
This Privacy Policy describes how HyperionX LLC, a Wyoming limited liability company ("HyperionX," "we," "us," or "our"), collects, uses, discloses, and protects personal information when you use our websites, desktop or web applications, beta programs, accounts, subscriptions, APIs, AI features, customer support, marketplaces, and related services (collectively, the "Services"). It does not govern a third party's independent services or practices.
Information you provide
- Contact and account information, including name, email address, login and profile details, communication preferences, plan, subscription status, and support history.
- Beta and community information, including trader type, experience level, X username, HPX-holder response, requested product access, and information included in your application or messages.
- Support and CRM information, including chat messages, emails, attachments, troubleshooting details, and other information you send to HyperionX or through the Crisp chatbox.
- Recruiting, media, investor, and affiliate information, including resumes, professional history, portfolio links, business contact information, inquiry details, affiliate application data, and identity or KYC information when required for an approved program.
- Trading and product content you choose to submit or connect, such as prompts, scripts, indicators, strategy settings, charts, watchlists, alerts, logs, simulations, paper-trading data, marketplace content, and integration settings.
- Billing and transaction information, including billing contact details, plan, price, payment status, transaction identifiers, and limited payment-method details provided by our payment processors. HyperionX does not need your full card number through support channels.
Information collected automatically
- Device and network information, such as IP address, browser, operating system, device type, language, approximate location derived from IP, and identifiers used for security or session continuity.
- Usage and diagnostic information, such as pages visited, referring page, interactions, timestamps, feature use, errors, crash reports, performance data, and security events.
- Consent and preference information stored in your browser, including whether you enabled optional analytics or CRM and live-chat technologies and when that choice was made.
- Information received from authorized integrations, brokers, market-data providers, authentication services, payment processors, or other connected services as needed to perform the action you request.
Sources of information
We collect information directly from you, automatically from your browser or device, from your use of the Services, and from vendors or services you choose to connect. We may also receive business contact information from public professional sources, referral partners, affiliates, event organizers, or people who direct an inquiry to us.
How we use information
- Provide, operate, authenticate, maintain, personalize, and support the Services and requested integrations.
- Process beta requests, accounts, subscriptions, payments, purchases, customer support, recruiting, affiliate applications, investor or media inquiries, and other requested communications.
- Generate requested AI outputs, run strategies or simulations, support automation, deliver alerts, debug errors, and improve product reliability and user experience.
- Measure website and product performance where permitted, remember privacy choices, understand demand, and develop or improve features.
- Protect accounts and infrastructure, prevent fraud and abuse, investigate incidents, enforce agreements, and comply with legal, tax, accounting, sanctions, and regulatory obligations.
- Send service, security, billing, legal, product, or marketing communications. You can opt out of marketing messages, but not transactional or security messages needed to provide the Services.
AI features and automated processing
Prompts, scripts, chart context, messages, files, logs, and other content submitted to AI-powered features may be processed by HyperionX and contracted AI or infrastructure providers to generate outputs, operate and secure the feature, troubleshoot problems, and improve the Services. AI outputs may be inaccurate and are not used by HyperionX to make legal or similarly significant decisions about you without human involvement. Do not place passwords, private keys, seed phrases, full payment-card numbers, government identification numbers, or unnecessary confidential information in prompts or ordinary support messages.
How we disclose information
- Service providers that perform hosting, infrastructure, AI processing, payments, email, communications, CRM and live chat, security, debugging, analytics, identity or KYC verification, and other operations for us.
- Brokers, exchanges, market-data providers, authentication services, creators, marketplace vendors, and integrations when you choose to connect or transact with them.
- Professional advisers, auditors, insurers, financial institutions, and legal or compliance providers as reasonably necessary for business operations.
- Government agencies, regulators, courts, law enforcement, or other parties when required by law or reasonably necessary to protect rights, safety, security, users, or the Services.
- A buyer, investor, lender, successor, or other counterparty in connection with an actual or proposed financing, merger, acquisition, reorganization, bankruptcy, or sale of assets, subject to appropriate confidentiality protections where applicable.
- Other parties at your direction, with your consent, or as otherwise disclosed when the information is collected.
Connected services and public content
When you connect a broker, exchange, wallet, social account, marketplace service, or other third party, each party may receive and process information according to its own terms and privacy policy. Content you intentionally publish in a marketplace, community, creator profile, review, or other public area may be visible to others and can be copied or redistributed outside our control. Disconnecting a service does not require the third party to delete information it already received.
Sale, sharing, and targeted advertising
As of the date above, HyperionX does not sell personal information for money and does not share personal information for cross-context behavioral advertising. We do not currently load third-party advertising pixels on this website. If our practices change, we will update this policy and provide notice and opt-out controls where required by applicable law. We do not discriminate against a user for exercising an applicable privacy right.
Cookies, local storage, and live chat
Our website uses essential browser storage to remember privacy choices and may use optional analytics or Crisp CRM and live chat technology only when the corresponding category is enabled. Crisp may process IP address, device and session information, conversation content, contact details, and attachments to deliver and secure chat support. The Cookie Policy explains current categories, duration, and controls.
Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including providing the Services, maintaining account and transaction records, preserving security logs and support history, meeting tax and legal obligations, resolving disputes, and enforcing agreements. Retention varies by data type, account status, program, contractual commitment, legal requirement, and operational need. We delete, de-identify, or aggregate information when it is no longer reasonably needed, unless law permits or requires longer retention.
Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information, including access controls and service-provider oversight appropriate to the information and Services involved. No online service, transmission, integration, or storage system is completely secure. Protect your devices, credentials, API keys, broker accounts, and authentication methods, and notify us promptly if you suspect unauthorized access.
Security incidents
We investigate suspected incidents and provide notices to affected individuals, regulators, or others when required by applicable law. The timing, content, and method of notice depend on the facts and governing law. In Wyoming, applicable law may require notice without unreasonable delay when misuse of certain personal identifying information has occurred or is reasonably likely to occur, subject to lawful exceptions.
International processing
HyperionX is based in the United States. We and our service providers may process information in the United States and other countries whose privacy laws may differ from those where you live. When required, we use appropriate contractual or legal safeguards for cross-border transfers. By using the Services, you understand that information may be processed in locations where we or our providers operate, subject to applicable law.
Your privacy choices and requests
- You may ask to access, correct, delete, or obtain a copy of personal information associated with you, or object to or restrict certain processing, subject to applicable law and lawful exceptions.
- You may update available account details, disconnect integrations, change cookie choices, or unsubscribe using the link in a marketing email.
- We may verify your identity before completing a request and may request information reasonably necessary to locate your records. An authorized agent may submit a request where applicable law permits and required authorization is provided.
- If we deny a request, you may ask us to reconsider by replying to the decision. You may also contact the privacy regulator or attorney general with jurisdiction where applicable.
California and other U.S. state rights
Residents of California and certain other states may have rights to know or access categories and specific pieces of personal information, correct inaccuracies, delete information, obtain a portable copy, opt out of certain sales, sharing, targeted advertising, or profiling, limit certain uses of sensitive personal information, and receive equal service. These rights apply only when the relevant law covers HyperionX and may be subject to exceptions. Because our practices can change, the categories of information, sources, purposes, and recipients described throughout this policy are also our current notice at collection.
Children
The Services are intended for adults and are not directed to anyone under 18. We do not knowingly collect personal information from children under 18. If you believe a minor has provided personal information, contact us so we can investigate and delete it where appropriate.
External websites
The Services may link to third-party websites or services. HyperionX does not control their privacy or security practices. Review the third party's policy before providing information or connecting an account.
Changes to this policy
We may update this Privacy Policy to reflect changes in our Services, practices, providers, or legal obligations. We will post the revised policy and update the date above. If a change is material, we will provide additional notice or obtain consent when required by law.
